By accessing or using PersistData, you agree to these Terms. If you are using PersistData on behalf of a company, you agree on its behalf.
PersistData provides a business data and enrichment API. We return professional and company information on request, metered in credits. We may add, change, or remove features over time.
You are responsible for your account and API keys, for keeping them confidential, and for all activity that occurs under them. Notify us promptly at hello@persistdata.com of any unauthorized use.
The service is metered in credits. We charge only for successful results — a lookup that returns no matching record does not consume a credit. Credit packs and subscription credits are subject to the validity periods stated at purchase: one-time packs expire after the stated period, and subscription credits refresh each billing cycle and do not roll over unless stated. Except where required by law, payments are non-refundable. Prices may change on a going-forward basis.
You agree to use the service only for lawful business-to-business purposes and to comply with all applicable laws, including privacy, anti-spam, and electronic-communications laws. You will not, and will not allow others to:
You will honor opt-out, unsubscribe, and deletion requests from the individuals you contact, and you will maintain your own privacy policy.
You are responsible for your use of the data and for your outreach. You will defend, indemnify, and hold us harmless from claims, losses, and expenses arising out of your use of the service or your violation of these Terms or applicable law.
The data is provided "as is" and "as available." Professional information changes constantly, and we do not warrant that any record is complete, current, or accurate. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, and our total liability for any claim is limited to the amount you paid us for the service in the twelve months before the claim arose.
We may suspend or terminate access for violation of these Terms or where there is risk to the service or to third parties. You may stop using the service at any time.
We retain all rights in the service, software, and website. We grant you a limited, non-exclusive, non-transferable right to use the service in accordance with these Terms.
We may update these Terms and will revise the "Last updated" date above. Continued use after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the State of California and applicable US federal law, without regard to conflict-of-laws rules. The state and federal courts located in California will have exclusive jurisdiction over any dispute, unless applicable law requires otherwise.
